Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your use of otherhalfbrewing.com, store.otherhalfbrewing.com, and any related pages, online stores, and services (together, the “Site”), operated by Other Half Brewing Company, Inc. and its affiliates (“Other Half,” “we,” “us,” or “our”).

By accessing the Site, creating an account, or making a purchase, you agree to these Terms. If you do not agree, do not use the Site.

Please read Section 15 carefully. It requires most disputes to be resolved through individual binding arbitration and waives your right to a jury trial or class action.

2. Age Requirement

You must be at least 21 years old to access the Site’s alcohol related content or to purchase alcohol. By using the Site, you confirm that you are of legal drinking age in your place of residence.

We may refuse service, cancel an order, or terminate an account if we believe a user is under 21. Providing false age information is a violation of these Terms and may be a violation of law.

3. Accounts

Some features may require an account. You agree to provide accurate information, keep it current, and keep your login credentials confidential. You are responsible for all activity under your account.

Accounts are personal and may not be shared, sold, or transferred. We may suspend or close accounts that violate these Terms, including accounts created to get around purchase limits.

4. Orders, Pricing, Payment, Pickup and Shipping

Orders. Placing an order is an offer to buy. We may accept, limit, or cancel any order, including for suspected fraud, reseller activity, pricing errors, or limited inventory. Releases may carry per person or per household limits, and we may cancel orders that exceed them.

Pricing and availability. Prices, products, and release dates may change without notice. We try to display everything accurately, but if we make a pricing or description error, we may cancel the order and refund you.

Payment. Payment is due when you order. Payments are processed by third party providers subject to their own terms. You authorize us to charge your chosen payment method for the total, including applicable taxes and fees.

Alcohol pickup. Alcohol orders are available for pickup at the taproom selected at checkout. The purchaser must present a valid, unexpired government issued photo ID showing they are 21 or older, matching the name on the order. We may refuse to release an order to anyone who cannot show valid ID or who appears intoxicated. Orders not picked up within 14 days may be cancelled and [refunded / forfeited], as stated at checkout.

Alcohol shipping. We ship beer only to states where we are licensed to do so, as listed on the Site; that list may change from time to time. An adult 21 or older must show ID and sign for delivery. Packages refused or returned for failed age verification may be refunded less shipping and handling, or not at all if the product cannot be resold.

Merchandise shipping. Non alcohol items ship to the address you provide. Title and risk of loss pass to you when we hand the package to the carrier. Delivery dates are estimates.

5. Events and Tickets

Tickets are for the named event, date, and location only. Unless the event page says otherwise, tickets are non refundable and non transferable, and resale above face value is prohibited. Guests at our taprooms and events must follow our Code of Conduct. Attendees must be 21 or older with valid ID unless the event is marked all ages.

We may change event lineups, times, or venues. If we cancel an event, we will refund the ticket price; we are not responsible for travel, lodging, or other costs. We may refuse entry or remove anyone who is intoxicated, disruptive, or violating venue rules, without refund.

By attending, you agree that we may photograph or film the event and use footage that includes you for marketing, without compensation.

6. Merchandise, Returns and Refunds

Alcohol. All alcohol sales are final except where required by law. If a product is damaged or defective, contact us within 7 days with your order number and a photo, and we will replace it or issue a refund or store credit at our discretion.

Merchandise. Unworn, unwashed merchandise with tags may be returned within 30 days of delivery for a refund or exchange. Sale items, gift cards, and custom items are final sale. Return shipping is the buyer’s responsibility unless the item arrived damaged or we sent the wrong item.

Refunds go back to the original payment method and may take 5 to 10 business days to appear.

7. Responsible Consumption

Please drink responsibly. Do not drink and drive, and do not consume alcohol if you are pregnant, taking medication that interacts with alcohol, or otherwise should not. Product descriptions, ABV figures, and tasting notes are approximate and provided for general information only.

You are solely responsible for your own consumption of products purchased through the Site.

8. Text Message and Email Marketing

If you opt in to text messages, you agree to receive recurring automated marketing texts from Other Half at the number you provide. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help.

You can unsubscribe from marketing emails using the link in any email. We may still send transactional messages about your orders, tickets, or account.

9. Intellectual Property

The Site and its content, including the Other Half name, logos, beer names, label artwork, photos, text, and design, are owned by or licensed to Other Half and protected by trademark, copyright, and other laws.

We grant you a limited, revocable, non exclusive license to view the Site for personal, non commercial use. You may not copy, reproduce, sell, or create derivative works from Site content, or use our trademarks, without our written permission.

10. User Content and Acceptable Use

If you submit reviews, photos, comments, or other content (“User Content”), you grant us a worldwide, royalty free, perpetual license to use, reproduce, and display it in connection with our business. You confirm you have the rights to anything you submit.

You agree not to:

  • Use bots, scripts, or automated tools to access the Site, place orders, or buy tickets
  • Purchase products for resale or circumvent purchase limits
  • Interfere with the Site’s security or operation, or access accounts or data that are not yours
  • Post content that is unlawful, infringing, harassing, or misleading
  • Use the Site to violate any law, including alcohol laws

11. Third Party Links and Services

The Site may link to or rely on third party services, such as payment processors, ticketing platforms, shipping carriers, and social media. We do not control and are not responsible for their content, policies, or performance. Your use of them is governed by their own terms.

12. Privacy and Cookies

Our Privacy Policy explains how we collect, use, and share personal information, and is part of these Terms. We use cookies and similar technologies as described in our Cookie Policy. You can manage your cookie preferences at any time through the cookie settings link on the Site.

13. Disclaimers and Limitation of Liability

Disclaimer. THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR FREE, OR FREE OF VIRUSES.

Limitation of liability. TO THE FULLEST EXTENT PERMITTED BY LAW, OTHER HALF AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCT. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $100.

Some jurisdictions do not allow certain warranty exclusions or liability limits, so some of the above may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless Other Half and its owners, officers, employees, and agents from any claims, losses, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms, your User Content, your misuse of the Site, or your violation of any law or third party right.

15. Dispute Resolution

Informal resolution first. Before filing any claim, you agree to email us at [email protected] with a description of the dispute and give us 60 days to try to resolve it informally.

Binding individual arbitration. Any dispute arising from these Terms, the Site, or any purchase that is not resolved informally will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Either party may instead bring an individual claim in small claims court if it qualifies. The Federal Arbitration Act governs this Section.

Class action and jury waiver. YOU AND OTHER HALF AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING, AND EACH OF US WAIVES THE RIGHT TO A JURY TRIAL.

Mass filings. If 25 or more similar arbitration demands are filed by or with the help of the same law firm or coordinated group, they will be administered in batches as the arbitration provider allows, and the parties will cooperate to resolve them efficiently.

Opt out. You may opt out of this arbitration agreement by emailing [email protected] within 30 days of first accepting these Terms, stating your name and that you opt out.

Governing law and venue. These Terms are governed by the laws of the State of New York, without regard to conflict of law rules. Any claim not subject to arbitration will be brought exclusively in the state or federal courts located in Kings County, New York.

16. Changes, Termination, Miscellaneous, Contact

Changes. We may update these Terms at any time by posting the revised version with a new “Last updated” date. Changes apply going forward. Continued use of the Site after changes means you accept them. Changes to Section 15 will not apply to disputes already noticed.

Termination. We may suspend or end your access to the Site at any time for violating these Terms. Sections that by their nature should survive (including 9, 10, 13, 14, and 15) will survive.

Miscellaneous. These Terms, with the Privacy Policy and any terms shown at checkout, are the entire agreement between you and us about the Site. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them, including in connection with a merger or sale of the business.
